The Publication Ban
Publication restrictions affect how I can speak about this experience. They also make clear, practical answers about those restrictions essential.
I have sought clarification and reconsideration. The issues include identifying information and the public disclosure of material covered by confidentiality restrictions. Those issues need to be understood accurately rather than treated as one unlimited instruction to remain silent.
Clarity is part of compliance
- Which information is restricted by each order?
- How do the restrictions apply to independently obtained records and firsthand experiences?
- What can be discussed without identifying a protected person?
- How do the separate orders operate together?
- What is the status of the reconsideration request?
I take the obligation to comply seriously. Uncertainty about scope has added another layer of work and stress to an already difficult process.
The underlying concerns remain
The orders address publication and confidentiality. They do not resolve my concerns about the care at issue. The handling of those concerns and the reasoning behind the relevant decisions still require examination.
Protecting privacy and explaining decisions are both responsibilities worth taking seriously. One should never become an excuse to abandon the other.
